We, OVERKIZ SAS and its affiliates recognise that privacy is important and we take the Data Subject’s privacy seriously.

Please read our privacy policy carefully as it describes Overkiz’s pratices, regarding collection, use, disclosure, retention and protection of any personal information processed in the field described below.

I- Processing of Personal Data – Overkiz as “Data Controller”

A) Scope of processing

This notice applies to :

  • any website belonging to Overkiz, including www.overkiz.com (hereafter “the Website”),
  • any use of Overkiz’s services, including the use of Overkiz’s application services, the use of Overkiz’s software, the use of Overkiz’s network cloud, which make reference to this privacy policy (hereafter “the Services”)
  • any contact with us by telephone or by email (technical support, after sales services, request of quotation or information about Overkiz’s services).
    By accessing and using Overkiz’s services or visiting any Overkiz website, you consent to our collection, storage, use and disclosure of your personal information as described below.

Any personal data are processed in a transparent, confidential and secured way.

Finally, we may update this Privacy Policy from time to time. For this reason, each time you visit Overkiz’s website, please read the Privacy Policy or return to this page periodically for any use of Overkiz’s services. B) Information that we request from you

1. Procedure used and the nature of information collected

We may collect and process Personal Data (defined under the EU Directive and Regulation as any information relating to an identified or identifiable natural person) about you through several ways:

a/ Personal Data may be collected and processed automatically in case of use of Overkiz’s Services.

b/ Personal Data may be also collected and processed when you visit the Website: via cookies we may collect data about what you are doing (see the “Cookies” section), or we may collect data when you register for an account to access our services online (such as an API library)

c/ or in the event of your communication with our employees regarding Overkiz’s Services (technical support, after sales services, request of quotation or information about Overkiz’s services).

We may also automatically collect and process Non-Personal Data, such as technical data (or data which does not allow for the identification of a natural person). Such Data may be provided from the use of Overkiz’s Services (notably the use of Overkiz’s network Cloud). Such processing ensures the performance of Overkiz’s Services and may be used by Overkiz with your consent in order to offer services, notably maintenance and support services for connected equipment.

Through statistical processing, Data under anonymous format allow us to improve our products and services.

In general, information we collect and process is required in order to perform the expected Services. It may be:

  • Identification data (such as surname, forename, title, postal address and/or e-mail address, telephone number);
  • Data relating to the security and management of customers’ accounts (passwords, username);
  • Data relating to the commercial relationship (product, services sale data, information about a technical problem, a request for assistance, or a quotation request);
  • Data relating to Connected Equipment or subscribed Services: device ID number, location of connected equipment, parameters about configuration settings for connected equipment, usage history;
  • Data relating to the files stored through your connected equipment: pictures, videos;
  • Network data: IP address of connected equipment, traffic data, wireless connection information.

2. Use of Data

a. We use the data we collect in order to:

  • Ensure the proper functioning and the constant improvement of our Website or any Services that our customers have ordered including the administration, the monitoring of Overkiz’s applications and network cloud;
  • The management and monitoring of the commercial relationship with Overkiz’s customers (e.g. technical support);
  • Ensure internal testing of Overkiz’s Services including the testing of security systems and to checking service level requirements;
  • Contact and inform Overkiz’s customers about services that we trust may be useful to them, based on the use of Overkiz’s application and network cloudi;
  • Improve the functioning of the Overkiz Websites and Services quality by compilation of statistics;
  • Be in compliance with the law and requests from the relevant legal or government authorities;
  • Undertake legal proceedings or exercise our right to defend ourselves;
  • Prevent fraud or any other illegal activity.

Any anonymous information collected gives us a better understanding of users’ preferences and habits and helps us to improve our Services in your best interests. Because anonymous data does not allow the person to be identified, we could be led to share the information with third parties, unless it is prohibited by law or otherwise and if it is protected by a specific non-disclosure agreement with Overkiz’s customer.

b. Any refusal to provide mandatory information will render the Services partially or wholly impossible to perform.

c. We may entrust the hosting of our websites or of certain services relating to your data to service providers. You can refuse this by asserting your rights as described below. In this case, access to our services may be affected.

3. Respecting the Data Subject rights and preferences

D) General rules governing personal data

1. Length of time personal data are stored

Overkiz stores personal data as used during the commercial relationship with the Data Subject only for the time needed to manage the said relationship.

The technical data and the data related to the use of Overkiz’s products and/or services will be kept for one year from their collection, except if you asked for an extension of this period of storage (e.g., in order to enjoy Overkiz’s maintenance services for a longer time).

2. Security of personal data collected

We have put in place the technical resources needed to prevent the accidental or abusive destruction, loss, deterioration, unauthorised disclosure, or modification of, or access to, your personal data.

Employees with access to personal data commit to respect the confidentiality of the information.

The fact that we enable you to access other websites by means of hypertext links shall not render us liable for any practices relating to personal data on these sites. II- Processing of Personal Data – Overkiz as “Data Processor”

A) Scope of processing

1. Length of time personal data are stored

This notice applies to the processing of personal data performed by Overkiz, on the behalf of third parties, e.g. our professional customers (such as manufacturer of connected equipment, i.e. the Data Controller).

Overkiz respects the principle that any processing of personal data operated on the behalf on its professional customers is done in a secured way. All the data processed remain the property of the Data Subject and/or the Data Controller.

Overkiz is not responsible for the final using and sharing of personal data by any Data Controller, but we recommend hardly our professional customers to process any personal data within the strict compliance of the applicable law.

B) Information that we may request from you

If you’re the Data Subject, please be aware that in this case, the processing of personal data is subject to the privacy policy of the Data Controller, even if you’re informed that such software solutions are connected to Overkiz’s network cloud.

If you’re acting as Data Controller and you intend to subcontract to us the processing any personal information about Data Subject (such as user of connected equipment), you must ensure that beforehand you have their explicit consent to do so and that you explain to them how we collect, use, disclose and retain their personal information and direct them to read your privacy policy.

C) Protection of data: confidentiality and security

Overkiz keeps the information of any Data Subject secure and confidential by taking appropriate technical and organisational measures against its unauthorised or unlawful processing and against its accidental loss, destruction or damage.

As Data Processor, Overkiz may exceptionally disclose Personal Data that we collect in the following limited cases:

1- request(s) of the Data Controller: if the Data Controller duly required Overkiz to disclose it. In this case, although Overkiz strongly recommends that our professional customers comply fully with the law, the final use and sharing of Data is done under the sole liability of the Data Controller.

2- subcontracting: if the disclosure is mandatory for our subcontractors to perform a service (such as the hosting of data for Overkiz). In this case, the disclosure is subject that the said subcontractor ensures satisfactory data security with regard to confidentiality, integrity and accessibility in connection with the processing of personal data.

3- legal requirement: if Overkiz is required to do so to comply with a legal requirement or request from a competent court, regulator or other authority;

4- statistical purpose: any anonymous information collected gives us a better understanding of users’ preferences and habits and helps us improve our services in your best interests. Because anonymized Non-Personal Data does not allow you to be identified, we could be led to share such anonymous data with third parties (such as consultants), unless prohibited by law or else it is expressly forbidden by the Data Controller.

In any case, Overkiz will take appropriate measures to ensure that any personal information about the Data Subject that Overkiz discloses to a third party will be used for the sole purposes for which it was provided.
